The first European Court of Justice decision concerning two Registered Community Designs

The European Court of Justice (the highest trademark/designs court in Europe) has rendered its first decision concerning two Registered Community Designs (RCD).

This came down in favor of the owner of the prior right, and thus reinforces the enforceability and value of the RCD in IP portfolios.

Historically severe verdict

A shopkeeper was at the Eastern Division of the Danish High Court sentenced a historically severe sentence for selling counterfeit goods.

The case involves more than 18,000 counterfeits, including clothing, shoes, razor blades and perfumes which have been seized in various markets across the country.

The Danish PTO has now received international recognition for its work to fight counterfeiting. This is done through the annual grant of Global Anti-Counterfeiting Awards in Paris and in the light of a recommendation from the Danish Anti-Counterfeiting (DACG) with Hanne Weywardt, partner MAQS Law Firm, as the initiator.
